DURATION OF LIMITED WARRANTY Software - 90 days

1. First EPoS warrants to you that First EPoS software will not fail to execute programming instructions after the date of purchase.

2. First EPoS offers the first 90 days of software support free of charge. Thereafter software support continues provided that an annual single site license fee of £125 excluding VAT is paid.

3. Software support consists of telephone support for operations/backup plus Hasp operation. First EPoS guarantees to make available any product enhancements as a result of product development.

4. Limitations and Liability: IN NO EVENT WILL First EPoS BE LIABLE TO THE LICENSEE FOR ANY CONSEQUENCE, INCIDENT, DAMAGES OR DEATH, INCLUDING LOSS OF PROFITS, SAVINGS OR BUSINESS, OR FOR ANY CLAIM BY ANY THIRD PARTY EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILTIY OF SUCH DAMAGES. This does not affect Statute Common Law. This agreement is governed and interpreted by the Laws of England. All jurisdiction remains in the English Courts.
